Acceptance of Terms

By accessing or using Operya AI, including this website, waitlist, product previews, integrations, APIs, communications, and any related features or services, you agree to these Terms of Service and any policies referenced here. If you do not agree, do not use Operya AI.

Use of Operya AI

Operya AI provides information about its products and may invite visitors to request early access. You agree to use this website only for lawful purposes and in a way that does not interfere with the site or other users.

Operya AI may provide AI-enabled operational, research, automation, or decision-support features. Those features are provided for informational and workflow-support purposes only and are not a substitute for professional, legal, financial, tax, medical, employment, or other regulated advice.

Waitlist Submissions

When you submit a waitlist request, you are responsible for providing accurate information. Submitting the form does not guarantee access to any private preview, product, or service.

We may accept, reject, prioritize, suspend, or remove waitlist requests or early access participants at our discretion. You authorize us to contact you about Operya AI using the information you submit.

Eligibility and Accounts

You must be at least 18 years old, or the age of majority where you live, to use Operya AI. If you create an account or receive access credentials, you are responsible for maintaining their confidentiality and for all activity under your account.

You must promptly notify us of unauthorized access or suspected account compromise. We are not responsible for losses caused by unauthorized account use unless required by law.

Acceptable Use

You agree not to use Operya AI to:

• violate law, infringe rights, or submit unlawful, harmful, or deceptive content;
• interfere with, overload, scrape, crawl, reverse engineer, or bypass the services;
• probe, scan, or test vulnerabilities without written authorization;
• upload malware or attempt unauthorized access to systems, data, or accounts;
• misrepresent AI-generated output as human-authored where disclosure is required; or
• use output to make high-impact decisions without appropriate human review.

Intellectual Property

The website, brand, copy, and related materials are owned by Operya AI or its licensors. You may not copy, modify, distribute, or use them commercially without permission.

Subject to these terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use Operya AI for its intended purpose. We reserve all rights not expressly granted.

Your Content and Data

You retain ownership of information, prompts, files, feedback, and other content you submit to Operya AI. You represent that you have the rights and permissions needed to submit that content and to allow us to process it.

You grant Operya AI a worldwide, royalty-free license to host, store, reproduce, process, transmit, display, modify, create derivative technical artifacts from, and otherwise use your content as needed to provide, secure, support, analyze, and improve Operya AI; develop new features; comply with law; and enforce these terms.

We may use aggregated, anonymized, or de-identified data and feedback for analytics, research, benchmarking, product development, commercial insights, and AI model or system improvement, provided that it does not reasonably identify you or your organization.

AI Output

AI-generated output may be inaccurate, incomplete, outdated, or unsuitable for your use case. You are responsible for reviewing output, validating facts, applying human judgment, and deciding whether and how to rely on any recommendation, workflow, analysis, or generated content.

No Warranties

This website is provided as is and as available. Operya AI does not guarantee that the site will be uninterrupted, error-free, or free from harmful components.

To the fullest extent permitted by law, we disclaim all warranties, express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, reliability, and security.

Limitation of Liability

To the fullest extent permitted by law, Operya AI will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of this site.

To the fullest extent permitted by law, Operya AI's total liability for all claims relating to the services will not exceed the greater of 100 U.S. dollars or the amount you paid us for the services in the three months before the event giving rise to the claim.

Third-Party Services

Operya AI may link to or integrate with third-party websites, software, models, APIs, payment processors, infrastructure providers, and data sources. We are not responsible for third-party services, content, policies, availability, accuracy, or security.

Termination

We may suspend or terminate access to Operya AI at any time, with or without notice, if we believe you violated these terms, created risk, caused harm, or used the services in a way that could expose us or others to liability. Upon termination, your right to use the services ends immediately.

Changes to Terms

We may update these terms from time to time. The updated terms will be posted on this page, and material changes may be communicated by reasonable means. Your continued use of Operya AI after changes become effective means you accept the updated terms.

Governing Law and Disputes

These terms are governed by the laws of the State of Delaware, without regard to conflict of law rules. Any dispute arising from these terms or Operya AI will be resolved through binding individual arbitration administered by the American Arbitration Association, unless arbitration is unavailable or prohibited by law.

You and Operya AI agree that disputes will be handled only on an individual basis and not as a class, consolidated, or representative action. If a court or arbitrator determines that arbitration cannot apply, disputes will be brought exclusively in the state or federal courts located in Delaware, and each party consents to those courts.

General Terms

These terms, together with the Privacy Policy and any additional terms we provide, are the entire agreement between you and Operya AI regarding the services. If any provision is unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver.
